| 内容記述 | 被害者参加制度は、刑事訴訟の本来の機能とは無関係に、それと矛盾しない限度において、被害者が刑事訴訟に関与すること自体から得られる心情等の安定を実現するための「被害者の福祉」のための制度である。公判傍聴および弁護人等への調査によれば、おおむね刑事訴訟の本来的な機能を阻害しない運用がなされているが、特に否認事件において、被害者の関与が防御活動を萎縮させるなどの問題がある。これを改善するためには、罪責認定過程と量刑過程の手続二分が必要である。 | |||||

| 内容記述 | A purpose of the victim’s participation in criminal trials is the increase of the victim’s welfare to the extent not inconsistent with the original function of the criminal trial. According to the survey results, the operation of the victim’s participation system does not inhibit the intrinsic function of the criminal trial. But in the cases that a defendant pleads not guilty, the victim’s participation inhibits the defense of the accused. In order to clear this problem, we need dividing criminal procedure in to finding fact and sentencing process. | |||||
