| 内容記述 | 2003年に国立大学法人法が成立し、国立大学法人制度がスタートした。この国立大学法人制度は、先行して制度化されていた独立行政法人を国立大学の設置者として活用することを意図した制度である。 従来、大学を含む我が国の学校教育制度において、学校は「法人格を持った設置者によって設置されるもの」であり、学校そのものに法人格は付与されてこなかった。国立大学法人も、大学そのものに法人格を付与したものではなく、例えば学校法人がそうであるように、「大学を設置するための法人」である。 国立大学法人制度は、その誕生時点から諸種の問題を内包し、また実際に運用される中でも多くの課題が指摘されてきた。国立大学法人法制定から約20年、その問題点に対し、法改正も含め、様々な形で政策的対応が行われている。 本稿では、特にその「法人性」に着目し、いくつかの問題点を指摘した上で、その問題点に対しどのような政策的対応が行われてきたのかについて整理を試みる。 |

| 内容記述 | The National University Corporation Law was enacted in 2003, and the National University Corporation system has been launched. This system is intended to utilize independent administrative agencies, which had been institutionalized in advance, as the establishers of national universities. In Japan's education system, including universities, schools have traditionally been established by establishers as corporations, and schools themselves have not been given juridical personalities. A National University Corporation is not a university itself, but a corporation for establishing the university with a juridical personality. The National University Corporation system has been fraught with problems since its inception, and many issues have been pointed out during its actual operation. In the 20 years since the National University Corporation Law was enacted, various policies, including legal revisions, have been implemented to improve these problems. This paper focuses on the "juridical personality" of the National University Corporations, points out some of the problems, and attempts to summarize the policy responses that have been taken to address these problems. |
